Ask your current IT provider what your recovery time objective is.
Most will read you a number off a service catalogue. Four hours. Next business day. In a litigation practice that number is not theirs to choose and it is not yours either. A docket control order chooses it. A discovery deadline chooses it. A limitations date chooses it. An SLA is a promise about effort. A scheduling order is a fact about consequences.
Texas puts the outer edge in writing. Under Texas Rule of Civil Procedure 21(f)(5), an electronically filed document is timely if it is filed before midnight, in the court’s time zone, on the day it is due. The rule is published with the state e-filing standards at eFileTexas. That is not a courtesy window. It is the last minute your network has to be working.
Which makes uptime a legal exposure at a law firm, not an IT metric.
Harris County removed the paper alternative years ago. The District Clerk states plainly that the order “mandates electronic filing in all Civil Courts and restricts us from accepting paper filing from any filer other than Pro Se filers,” per the office’s own e-filing FAQ. If your client is represented, there is no counter downtown to walk up to at 4:55.
